Homeowner Dispute FAQs
What steps do you take to represent homeowners in disputes with builders?
We begin by reviewing all contract documents and inspection reports to identify issues. Then, we communicate directly with the builder or tradie to seek resolution. If necessary, we prepare and lodge formal complaints with the QBCC and QCAT. We also represent homeowners at QCAT hearings ( if allowed), providing technical evidence and advocacy throughout the process.
How does the QBCC dispute resolution process work?
The QBCC process involves lodging a complaint about building defects within stipulated time, within 1 year for non-structural defects and within 6 years and 6 months for structural defects. QBCC investigates and facilitate Early Dispute Resolution (EDR) between parties for contratcual issues. They can also issue Direction to Rectify (DTR) orders to licenced or unlicenced contractor to fix defective or incomplete work or consequential damage. If unresolved, the matter can escalate to QCAT for a formal hearing. We guide homeowners through each stage, ensuring their rights and interests are protected.
What types of disputes can you assist with at QCAT?
We assist with disputes involving defective workmanship, incomplete work, contract variations, delays, and payment disagreements. Our technical expertise allows us to present clear evidence and negotiate outcomes that align with homeowners’ contractual rights and expectations.
How long does the dispute resolution process usually take?
The duration varies depending on the complexity and cooperation of parties. Initial QBCC conciliation can take several weeks to few months, while QCAT hearings may extend the process by a several months. We keep homeowners informed at every step and work efficiently to resolve disputes promptly.
